My Sound Card was the culprit "Xonar D2X"

If you have an newer AMD card you can use MLAA (http://sites.amd.com/us/game/technology/Pages/morphological-aa.aspx) on this game. It actually smooths out the 2D sprites, not just the 3D polygons. Ran a screenshot through a program (http://www.iryoku.com/mlaa/#downloads) to give you a rough idea what the difference is:

It's really a matter of preference, but people running at high resolutions and/or on large displays might like it better with MLAA on.

The screen tearing can be fixed using D3DOverrider, which comes packed with Rivatuner (http://www.guru3d.com/index.php?page=rivatuner). You have to install Rivatuner then snag D3DOverrider from its install directory as I recall (dumb that is isn't separate). You can just uninstall Rivatuner after, though. D3DOverrider is very, very useful for games where you can't get Vsync working any other way.
