i dont know about you but i love to roleplay this game hardcore so first things first. Why is your skyrim character a prisoner in skyrim?
Here is mine as of right now (it may change as i think about it)
Cyrodiil is ran by a tyrannical emperor and is now starting to take control over the entire population. Under this iron fist my character a wood elf thief is getting crushed. The emperor has order the extinction of all elves and insist it be done swift. He must escape his fate! with the help of a shady dark elf character by the name Dorvvin he will flee Cyrodiil and his death. But how? with a potion that can change him into anyone the user desires, but there is a catch. To escape Cyrodiil he must first assassinate an Elder Council member from skyrim. One that will be in the emperial city soon to deliver a book to the emperial palaces library. This elder council members death will mean the last of the dragon slayers. (bear with me, im not completely fluent in TES lore) This mission is presented to him by the last of the dragon born as well. He knows his death is imminent and must carry on his title to an unknown and unknowing soul.
Assassinating the Nord council member will be followed by an arrest by his fellow Nord body guards who, due to their proud nature, will only see it fit to behead and humiliate this assassin (me) on their home ground for all to see. It is now that he is a prisoner in skyrim that he takes the potion and chooses his new identity (character creation) and escapes his captors to live a life in the more suitable skyrim. Yet, unknown to the thief he was chosen as dragonborn and will soon learn his destiny.
Thats it haha it was all just for fun!! so dont tell me how impossible and untrue to TES lore it is! i will fine tune it and what not, but that is the basis (also i didnt waste time with grammar)

I just figured that by now being a prisoner (with little or no explanation) was an Elder Scrolls tradition; the only game that HASN'T done it by default is Daggerfall. =P As for this time... I suppose anything can happen when you're caught in the crossfire of a civil war.

Yeah, I always liked the "start up imprisoned" angle, because you could come up with an idea of what kind of person you are based on how you imagined you got put in there.
I usually don't come up with detailed backstories for my characters, though, beyond them once being an average person in the world. The Elder Scrolls games have, to me, always been about ordinary people rising up to face extraordinary challenges.

I kinda agree with varagix on this one. I never really think up of much of a background. I want my guy to be an average person who was probably just in the wrong place at the wrong time, and then falls into this extraordinary adventure that slowly changes him from a plain person to a world renowned hero. Much like "coming-of-age" fantasy novels which are quite abundant, my favorite being The Wheel of Time series, if you what that is ;)

I always just start my characters' stories with "Little did she know that there are legal limits to what you can do with a goat, a blowtorch and a wheel of rotting cheese..."

well this is sort of the first time i have ever thought up a story for my character or anything and i do agree that it kind of does just make sense to start from humble beginnings (unless you have a goat, blowtorch and a wheel of rotting cheese 0_o) and become someone extraordinary. Well, that is what happens when i have a long drive to work and nothing else to think about haha

My character is a Japanese schoolgirl transported into the Elder Scrolls world wearing kawaii anime clothes with her katana and m95 barrett sniper rifle and her best kawaii friends to help her defeat the evil bad men also her best friend is really dark and mysterious who she loves and the khajeets will be changed into kitty women because thats more realistic ^__^

my character is an uber god.. he got into a fight with another god.. then he lost..beaten so bad.. he ends up in jail with no previous memory..he becomes weak at the start of the game (low level) becoz he doesnt know that he is a god n thought himself to be a normal human.

Sounds like my Nord bard idea, save for the ale. Any Nord worth the hair in his beard knows that mead is a real man's drink. :D

My character is in jail waiting for his big fat mean rich oppressive tyrannical step-mother to come and bail him out... but then he breaks out and decides to leave behind his former life and build his own fortune. He goes on a crazy adventure and saves the world... but at the end he wakes up and realizes it was a dream and that he's actually in prison forever for murder... but then he wakes up and realizes it was a nightmare and that he's in his bed in his cottage by the lake. But then he wakes up and realizes he's from the year 2011 and that he just fell asleep / temporarily died after overdosing on hallucinogenic drugs.

In the year 1968 red engineer decides he can no longer wait approximately 43 years for the development and release of Skyrim and develops an inter-game-dimensional portal device so he can go there himself
Unfortunately a mishap involving sappers, demoknights, and scout's mother results in the malfunction of this device which proceeds to rip a Gestir from PVKII ("http://store.steampowered.com/app/17570) from his plane of existence and drop him into a small town on the border between skyrim and highrock. The gestir, assuming the strange land he is now in is VALHALLLAAAA proceeds to slaughter every armed person in sight, only beginning to suspect something is amiss when the "vikings" he is slaughtering with ease call him CRIMINAL SCUM and order him to stop. Enraged at this foul trickery he levels the town in what is later called a dragon attack to protect citizens from the terrifying thought that a single man was able to cause this much devestation.
Though he fought valiantly and killed over 500 armed guards and militiamen he was eventually subdued and quickly sentenced to death for his monstrous crimes. The leaders of skyrim, terrified of the gestir's ungodly skill with the spear and javelin, quickly ordered the destruction of every spear in skyrim and declared spears from morrowind contraband.
Hours away from execution, various prisoners are being escorted across a road to Whiterun for their execution. The gestir looks to the sky as suddenly the guards are attacked by a great leathery winged beast. The gestir escapes in the confusion, determining his only way into Valhalla is to kill these dragons...

I haven't given much thought about my Skyrim character, but here's my Oblivion character:
Wandering through the Imperial City, I heard some merchant woman talking about how her caravan took far longer on their journey to avoid Hammerfall. They were afraid of us Redguard looting their wagons. She put all the blame on the Redguard, and each further breath revealed more of her bigotry. So I smacked that ♥♥♥♥♥ upside the head. "AW HEEELLLLL NAHW, DON'T YOU BE TALKIN' BOUT MY HOOD LIKE THAT." She looked up at me with what appeared to me remorse. She opened her mouth and took a breath to speak. I had already decided I wasn't going to accept her apology. "Guards!"
"OH SHIET!" I sprang with the quickness like lightning and disappeared, but to no avail. I thought I was safe in this stranger's basement, but as I was about to make my way outside, a man stepped in. "STOP RIGHT THERE CRIMINAL SCUM! NOBODY BREAKS THE LAW ON MY WATCH!" I laughed. "I JUST DID, FOOL. SOME GUARD YOU ARE." I was hauled off to jail for defending my honour. The guards should known that I was no criminal. Their king recognized my greatness and let me out.

in jail for what i inevitably end up in jail for a guard annoyed me so i decided too take the massacre route and stab him in the face then all of his buddies too and so began a long chain of me slaughtering guards and fleeing while cackling maniacally

I never did like the whole "wrongly imprisoned" thing. If I'm going to be in jail, it had better be for a damn good reason.
Cannibalism. The dragon soul within me has driven me mad with hunger. Unfortunately, I was caught feasting on the flesh of my own kind at the end of a short killing spree. I will often wonder why the guards didn't kill me on the spot.

I always thought it was kind of interesting how the intro in Oblivion makes it seem like you may not have actually had a past and that whatever forces are at work in the Elder Scrolls created you at that moment. Like how the guards comment on how that cell shouldn't have a prisoner in it and I think the Dunmer guy in the cell across from you even comments how he didn't know anyone was in your cell.
Other than that though I usually just use the same thing a few people have mentioned. Disorderly/barfight/drunk exploits/etc. Especially when I go into random bars in the game world and start punching the first guy that says something to me, then try to escape once someone calls the guards. What?! I didn't kill anyone! And I always choose the jail time over the fine. I spent enough time in jail with that character that the guards started acting all buddy-buddy with me and their dialog changed. Which I thought was pretty cool that they stuck that in the game. And because of that, my bar fights will continue in Skyrim in hopes they through something similar in...

All my characters are in jail for public nudity and/or drunk driving (with a horse ofc). Sometimes they even get jailed for trolling in achan. (a=4)-2+1

My character brought down a dragon over a small town causing some catastrophic structural damage to the town square, since he was unable to pay for the collateral damage he has been sentenced to death.

My ancestors had lived near Rihod in Hammerfell as farmers, having migrated from Orsinium long before memory. Battling prejudice and constant poverty, my ancestors escaped Hammerfell into Cyrodil. Then in 3E 433 came the Oblivion Gates. Hearing there was a hero wanderer who was able to close the Oblivion gates, our clan was determined to find this hero. After wandering Cyrodil as refuges for nearly a year they were unable to locate this hero. Eventually the forces of good prevailed and the gates were closed for good. My ancestor's eventually settled in the Colovian Highlands near the town of Chorrol. Growing used to life amongst the Imperials my clan chose to stay. Many generations later came a time of darkness. Chorrol became a City-State unto it's own. We and the rest of the populace watched helplessly as town after town splintered from the Empire. Then in 4E 171 the Alderi Dominion came, enslaving or slaughtering all in their way (all non-Thalmor that is). The Great War ended with the White-Gold Concordat, despite this we were heartened to learn that Hammerfell had rejected the treaty and left the Empire.
My brothers (Un-Khan and Udu-Khan the Younger) and I fled when the Thalmor appeared and slaughtered all the Orc's in my village. We went into the hills to join the resistance. We were little more then peasant farmers. We knew not the ways of war. Near Pale Pass my brothers were killed as I watched. I tried to escape into Skyrim. That is tried. I could not get passed the checkpoint and during the struggle was hit from behind. Before darkness took hold I had prepared to meet my ancestors.
