Agree, it's the Vita Saw example again. You make an item in homage to something you like. The right way is asking the holder of copyright for permission (and abide by the rules they set, as in the Vita Saw example meant no getting money from it)

What you don't do is get other people's work, sign it as your own creation and start getting money from it.

IMO if you cheat, steal, etc and get caught then you should be punished for it. Don't try to deflect the attention and whine or cry that someone else that cheated or stole received a different punishment. That's what children do. You stole something, you got caught and you got punished for it. Suck it up, be a man and live with the consequences of your decisions.
