I know this isn't possible, but atleast let us trade games that aren't played at all.

I'm sorry, but no. All of that must be maintained in some form. Cutlery deteriorates with time, it oxidates if it's made of metal, and plastic cutlery breaks easily. What you're basically saying is that with selling only one product they should be fine. Sure! Let's sell only one copy of the game, that costed thousands of dollars to make, and then allow people to trade it. We already made $50, right?

The developer loses a potential sale. Let's say the game was at $50. Instead of making $100, they only made $50. Now let's say your friend gives it to another friend. The dev lost $100. And so on.

Comparing digital goods (Steam games) to physical goods isn't a good analogy, since physical goods deteriorate over time. The car company still makes money by selling spare parts, and selling new cars. Let's face it, a car bought today won't be as good in 10 years. A game bought on Steam today, however, might even be better in 10 years (with updates and such).

I'm sorry, but if you bought a crappy game it's your fault. There's no need to buy every game on release. Just wait a few weeks, and see the general opinion of the game.

Yes, every piece of software you buy is a license. You don't own the software you buy, only the person who made it owns it. You only purchase a license. It has been like this since way before Steam even existed. Of course, it couldn't be enforced at first, but that's the way it is.

I still think www.greenmangaming.com 's solution to trading a used game is the best as the gamer gets a small return on games that they no longer play and devs don't lose sales.

There is a nice bit about quality as well - something that the new Tom Clancy's Future Soldier game would fall foul off...
The "quality" that you're talking about would be that of "ranking" or "score" rather than the quality that would be stated in a law which would be how well it works, how easy is it to break and so on. And about the returning/deleting of content, I'm sure there is a line in the Steam user agreement about that, as I've seen similar lines in/on digital products.

If you actually bought a game, in the technical sense, you'd be obtaining the source code for it and all rights that go with its ip, which alone costs millions for sequels and such.
