Weird unchangeable framerate

Hey I got an issue where the game's FPS only moves around 40-50 FPS even if I'm playing on the lowest settings example of rig and test:

RIG:

i7-860
4 Gb RAM
Win 7 64bit
ATI 5770 10.11
500GB HDD

VSYNC is OFF!

Ingame setting:

Test 1
192x1080
4x AA
4x AF
Ultra
Trilinear

FPS: 40-50

Test 2

800x600
0x AA
0x AF
Low Texture
Trilinear

FPS: 40-55

Anyone no anything special?

Could it be Ati drivers?

Turn off "sync every frame"

.....updated OP. Forgot to mention that Vsync is off, no matter what my Refresh rate is 60Hz so the example is unaffected with or without Vsync!
