No steam overlay when in software render mode?

I just bought SM4 for steam (I did have the retail version a long time ago but I lost it) and when you enable software rendering the steam ingame overlay doesn't display, is there any way to fix this? Would be nice to be able to use the software rendering mode so I can use the ingame overlay, never been much of a fan of the Alt+Tab method.
