What can I do " duplicate product code"

I just got mw2to my house yesterday from amazon from this californiabookmart person only to find out the cd key is already used

What can I do. This should be illegal to sell already used cd key in amazon. Can I take them to court or something because I contacted them via email yesterday and no answers yet.

I don't think amazon will do anything bout it. I am asking is it legal for them to sell me mw2 with a non legit cd key. I got the mw2 cd box from amazon and the cd key with the manual but the cd key doesn't work it said its already activated under some other account.
